General Terms and Conditions

§1 Scope and Customer Definitions

These Terms and Conditions apply to all business relationships between you (hereinafter “customer”) and:

These terms apply regardless of the customer’s country of residence. Deviating, conflicting or supplementary terms shall not apply unless expressly confirmed in writing.

Customers are classified as:

  • Consumers: natural persons entering into a transaction for purposes predominantly outside their trade, business, or profession.

  • Business customers: natural or legal persons or partnerships acting in the exercise of commercial or professional activity.

Please note: legal rights and obligations may differ based on customer classification (e.g., right of withdrawal, liability limitations, warranty terms).


§2 Offer and Conclusion of Contract

All product presentations on our website are non-binding and subject to availability.

By placing an order, the customer submits a binding offer. Confirmation of receipt does not constitute acceptance. A contract is concluded only through our express acceptance via email or shipment of the goods.

In the case of payment via immediate payment methods (e.g., PayPal, Klarna, credit card), the contract is formed upon successful payment — subject to product availability. We reserve the right to withdraw from the contract in case of errors, unavailability, or pricing mistakes, in which case a full refund will be issued.

Orders can be accepted within five (5) days via email or dispatch confirmation. Customers are responsible for ensuring the accuracy and availability of their provided email address.


§3 Products, Prices, and Payment

The subject matter of the contract is the sale of goods as listed in product descriptions or custom offers.

All prices include VAT where applicable under EU law. Shipping costs are displayed separately before checkout and are payable by the customer unless stated otherwise.

Payment methods may include:

  • Klarna (invoice, installment, direct debit): subject to credit approval. Klarna’s terms apply independently.

  • PayPal / PayPal Checkout

  • Credit card / SEPA bank transfer
    All payment processing is handled by third-party providers, who act as independent data controllers under their own privacy policies.

Unless otherwise agreed, all payments are due immediately upon conclusion of the contract.


§4 Delivery, Shipping, and Transfer of Risk

We deliver to the address specified during checkout. Multiple shipments may occur. Delivery times stated on the website are non-binding unless confirmed.

Transfer of risk:

  • For business customers, risk transfers upon handover to the carrier.

  • For consumers, risk transfers upon delivery to the customer or authorized recipient.
    If the customer selects their own carrier, risk transfers at handover.

International Orders: Any customs duties, import taxes, or handling fees incurred for non-EU deliveries are the responsibility of the customer.


§5 Retention of Title

Ownership of the goods remains with William Fan until full payment has been received.

Business customers must inform us immediately of any third-party access to goods under retention of title (e.g., seizures).


§6 Warranty and Liability

Statutory warranty rights apply to all goods.

  • Consumers are encouraged to inspect deliveries immediately and report defects promptly. Failure to notify does not affect statutory rights.

  • Product variations from descriptions are only binding if explicitly confirmed in writing prior to contract conclusion.

Limitation of liability:
We are liable only for intentional acts and gross negligence. In the case of slight negligence, liability is limited to foreseeable damages typical for the type of contract.
This limitation does not apply to personal injury, liability under product liability laws, or in cases of fraud.


§7 Right of Withdrawal (Consumers Only)

Consumers have the legal right to withdraw from the contract within 14 days without giving any reason.

Start of withdrawal period:
The period begins when the consumer or a third party (not the carrier) has taken possession of the last item.

Effects of withdrawal:
We will refund all payments, including standard shipping, within 14 days using the original payment method. Refunds do not cover extra services (e.g., express shipping). The customer bears the cost of return shipping.

Exclusions:
The right of withdrawal does not apply to goods made to customer specifications or clearly personalized items.


§8 Order Process and Technical Steps

Orders are submitted through the online shopping cart system. Before finalizing your order, you may review, correct, or cancel it using your browser or input devices.

Once submitted, the order cannot be edited via the website. Please review all information carefully before completing checkout.


§9 Contract Language and Storage

The contract is offered in English. A permanent contract archive is not maintained.
Customers may print or save the order summary before submitting it. After purchase, we will send a confirmation email containing all relevant order data, terms, and legal information.


§10 Data Protection

Personal data is processed solely in accordance with our Privacy Policy.
Legal bases for processing include the performance of a contract, legal obligations, and our legitimate interests.
Customers may request information, correction, or deletion of their data at any time in line with applicable regulations.


§11 Governing Law

All contracts are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection laws of the country of residence remain unaffected.


§12 Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
We are not obligated to participate in consumer arbitration proceedings but are open to informal resolution approaches.
